These Terms of Service govern your use of the Misfortune Studios website and your purchase or use of products and services offered by Misfortune Studios LLC.

Throughout these Terms, “Misfortune Studios,” “we,” “us,” and “our” refer to Misfortune Studios LLC.

2. PRODUCT INFORMATION

We make reasonable efforts to accurately display and describe our products.

Because displays, lighting conditions, garment production, printing processes, washing, distressing, and other manufacturing characteristics may vary, minor differences may occur between photographs and physical products.

Handmade, printed, distressed, washed, or limited-production products may also contain reasonable production variation.

Such ordinary variation does not necessarily constitute a defect.

3. PRODUCT AVAILABILITY

Products may be released in limited quantities and may sell out.

Adding an item to a cart does not reserve inventory unless Shopify or the applicable checkout system expressly indicates otherwise.

We may limit quantities available for purchase when reasonably necessary to protect inventory availability, prevent fraud, or maintain fair access to limited merchandise.

4. ORDERS

All orders are subject to acceptance, payment authorization, inventory availability, and fraud review.

We reserve the right to refuse or cancel an order when reasonably necessary, including in cases involving:

Suspected fraud
Payment problems
Incorrect pricing or product information
Inventory errors
Suspected resale abuse
Technical errors
Violation of these Terms

If we cancel an order after payment has been captured, the applicable amount will be refunded.

5. PRICING

Unless otherwise stated, prices are displayed in U.S. dollars.

Prices, products, promotions, and availability may change without notice.

A pricing error does not obligate Misfortune Studios to complete a sale at an obviously incorrect price.

6. PAYMENT

Payment is due according to the options displayed during checkout.

Payment processing may be provided by Shopify and other third-party payment providers.

Misfortune Studios does not independently control every payment method or payment-provider authorization decision.

7. TAXES

Applicable sales tax or other required charges will be calculated and collected where required.

8. SHIPPING

Shipping availability, processing expectations, carrier information, address responsibilities, and shipment issues are governed by our Shipping Policy.

Misfortune Studios currently ships within the United States only.

9. RETURNS, REFUNDS, AND EXCHANGES

Unless otherwise required by law or specifically stated in our Refund Policy, all sales are final.

Damaged, defective, or incorrect merchandise must be reported according to the procedures and deadlines contained in our Refund Policy.

10. PRE-ORDERS

If Misfortune Studios offers a product specifically identified as a pre-order, additional product-specific terms may apply.

Estimated availability or shipment dates for pre-orders are estimates and may change because of manufacturing, freight, customs, quality-control, or other production circumstances.

Any material pre-order conditions will be disclosed before purchase.

A product should not be treated as a pre-order unless it is expressly identified as one.

11. INTELLECTUAL PROPERTY

Unless otherwise stated, the Misfortune Studios name, branding, original graphics, photographs, artwork, product designs, written content, website content, campaign materials, and other original creative materials are owned by or licensed to Misfortune Studios LLC and are protected by applicable intellectual-property laws.

No content from the website may be reproduced, distributed, commercially exploited, falsely attributed, or used to create unauthorized merchandise without appropriate permission.

12. THIRD-PARTY SERVICES AND LINKS

Our website may rely on or link to third-party services, including Shopify, payment processors, shipping carriers, social platforms, or other service providers.

Those services may be governed by their own terms and privacy practices.

Misfortune Studios is not responsible for the independent operation of third-party platforms beyond what applicable law requires.

We do not guarantee that the website will always operate without interruption or error.
